Right to Manage (RTM)

If you own your flat you have a statutory right to choose its management...

If you are a long-leaseholder in a block of flats it is now your legal right to choose who manages your property. It is known as The Right to Manage or RTM.

In cooperation with The Right to Manage Federation we provide a comprehensive service to help you exercise RTM. Our service is all inclusive and covers everything including land registry searches and the service of all legal notices. The whole process usually takes 5-6 months.

Parliament passed this legislation to help flat owners like you. It is not necessary to prove fault by your landlord or management company or to pay any compensation. Flat owners all over the country are now turning to RTM as the best solution to achieving higher standards and increased value for money. As long as at least half the leaseholders in your block agree to proceed your landlord cannot legally obstruct the process. Under the Commonhold and Leasehold Reform Act 2002, it is your legal right to choose who manages your building.

If your building meets the following criteria then you are entitled to acquire the right to manage: -

  1. The building is self-contained.
  2. It has at least two flats.
  3. At least two-thirds of the flats are owned by 'qualifying tenants' *
  4. If part-commercial the non-residential part does not exceed 25% of the total floor area.
  5. At least half the leaseholders in your block are in agreement to proceed.

* A 'qualifying tenant' is a leasehold owner whose lease was originally granted for a term of more than 21 years.
